Technical Resignation - Central Govt. Employees

 



"Technical Resignation" is a specific procedure within the Indian government's service rules, governed by the Department of Personnel and Training (DOPT). 

  • Unlike a standard resignation, it's a "technical formality" that allows a government employee to resign from their current post to take up a new one in the same or another government department without losing certain service benefits.
  • This is a crucial distinction, as a regular resignation generally leads to the forfeiture of all past service and related benefits.

Conditions for Technical Resignation

For a resignation to be treated as a technical resignation, the following conditions, as per DOPT rules, must be met:

  • Application through Proper Channel: The employee must have applied for the new post through the proper channel (i.e., with permission from their current department).
  • Intimation of Application: In cases where an employee applied for the new post before joining their current government service, they must inform their new department about the application immediately after joining.
  • Specific Request: At the time of resignation, the employee must explicitly state that they are resigning to take up a new government appointment and request that the resignation be treated as a technical one.
  • Verification: The authority accepting the resignation must be satisfied that if the employee had been in service at the time of the application, it would have been forwarded through the proper channel.

Benefits of Technical Resignation

A technical resignation provides significant benefits to the employee, ensuring a continuation of their service without a break. These benefits include:

  • Continuity of Service: The past service is counted for the purpose of pension, leave, and other benefits.
  • Pay Protection: The employee's pay in the new post is protected and may be fixed with reference to their pay in the previous post.
  • Leave Carry Forward: All accumulated leave, including Child Care Leave (CCL), is carried forward to the new post.
  • LTC (Leave Travel Concession): The entitlement to LTC is also carried forward.
  • GPF/NPS: The balance in the General Provident Fund (GPF) or the Personal Retirement Account Number (PRAN) under the National Pension System (NPS) is transferred to the new office.
  • Seniority: While seniority in the substantive post is protected, the period spent in the new department will generally not count for promotion in the old department if the employee decides to rejoin their substantive post.
  • It is important to note that a resignation from a post held on an ad-hoc basis cannot be treated as a technical resignation.

Technical Resignation to PSU/State Govt.

In case of permanent absorption in PSUs/ Autonomous Bodies/ State Government etc., the Government servant shall be granted cash equivalent of leave salary in respect of EL & HPL at his credit subject to overall limit of 300 days. - Rule 39-D of the CCS(Leave) Rules,1972
 

Payment of Gratuity on Technical Resignation

For government employees under NPS who submit a technical resignation, the rules of gratuity are governed by the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021
